Minimalisasi Kontroversi Omnibus Law Dalam Pembentukan Undang-Undang
Abstract
Pembentukan undang-undang melalui omnibus law seringkali tidak demokratis, pragmatis, mempersempit ruang partisipasi dan mengabaikan penghormatan terhadap harkat dan martabat manusia, sehingga omnibus law menimbulkan kontroversi. Artikel ini dimaksudkan untuk mengulas cara mengatasi kontroversi dalam pembentukan undang-undang melalui omnibus law. Penelitian ini menggunakan metode penelitian yuridis normatif, dengan pendekatan perundang-undangan, kasus dan perbandingan. Hasilnya menunjukkan: (1) Penerapan pembentukan undang-undang melalui omnibus law berulangkali menjadi kontroversi, utamanya terkait dengan minimnya partisipasi publik. (2) Model partisipasi pada pembentukan undang-undang melalui omnibus law menjadi lebih bermakna apabila dilakukan dengan memberikan kemudahan akses bagi masyarakat. Lebih sempurna jika dilengkapi dengan Sistem Informasi Geografis Partisipasi Publik.
